1. Agreement

By accessing or using Fiecom ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Fiecom is an AI-powered cinematic website generator. The Service allows users to generate, preview, edit, and publish websites using artificial intelligence. The quality, style, and content of any generated output depend on the prompts and assets you provide. We do not guarantee any specific result, suitability for a particular purpose, or commercial outcome.

3. Eligibility & accounts

You must be at least 16 years old to use the Service. You are responsible for the accuracy of registration information and for maintaining the security of your account credentials. We are not liable for losses caused by your failure to secure your account.

4. Acceptable use

You agree not to use the Service to generate, store, or distribute content that is illegal, defamatory, infringing, hateful, sexually explicit, deceptive, or harmful, or to attempt to reverse-engineer, scrape, or overload the platform. See our Acceptable Use Policy for the full list. We may suspend or terminate accounts in breach without prior notice.

5. Intellectual property

Your content: You retain ownership of any assets you upload. By uploading, you grant Fiecom a worldwide, non-exclusive, royalty-free licence to host, store, and process those assets solely to provide the Service.

Generated output: Subject to your compliance with these Terms and payment of applicable fees, you may use the generated output for your lawful purposes. AI-generated content may not always be unique; identical or similar outputs may be produced for other users. We make no warranty that the output is free from third-party rights claims arising from your prompts or uploaded materials. You are solely responsible for verifying that your use of any output does not infringe third-party rights.

Our IP: All Fiecom technology, branding, and platform code remain our exclusive property.

6. AI-specific disclaimers

The Service relies on third-party AI models that may produce inaccurate, biased, or unexpected results. You acknowledge that:

• AI output may be factually incorrect, outdated, or inappropriate.

• You are responsible for reviewing all generated output before publishing or relying on it.

• Fiecom is not liable for any decision or action taken based on AI-generated content.

7. Plans, credits & payment

Subscriptions are billed monthly in advance and renew automatically until cancelled. Credits are non-transferable, non-refundable, and expire at the end of each billing cycle. We may change pricing on 30 days' notice; new prices apply to the next renewal.

8. Cancellation & refunds

You may cancel at any time from your Billing dashboard. See our Refund Policy for details. We do not provide pro-rated refunds for unused portions of a billing cycle.

9. Suspension & termination

We may suspend or terminate your access at any time for breach of these Terms, suspected abuse, non-payment, legal requirement, or for any other reason at our reasonable discretion. Upon termination, your right to use the Service ends immediately.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT GENERATED OUTPUT WILL MEET YOUR REQUIREMENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIECOM AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO FIECOM IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR EUR 50, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY; IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to defend, indemnify, and hold Fiecom and its affiliates harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your content, prompts, or generated output; (c) your violation of these Terms; or (d) your violation of any third-party right.

13. Third-party services

The Service integrates with third-party providers (e.g. Stripe, AI model providers, hosting). We are not responsible for the acts or omissions of third parties, and your use of their services is governed by their own terms.

14. Modifications

We may modify these Terms at any time. Material changes will be notified by email or platform notice. Continued use after changes take effect constitutes acceptance.

15. Governing law & jurisdiction

These Terms are governed by the laws of the Netherlands. Any dispute will be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands, except where mandatory consumer law provides otherwise.

16. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government action, internet/network failures, or supplier outages.

17. Severability & entire agreement

If any provision is held unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and Fiecom regarding the Service.
